After consulting the report from an MEP about strengthening the protection of personal data, the CNIL unveils its position. The Commission will support the text and support its weight so that it is picked up by the European Parliament.
CNIL logoLast week, environmentalist MEP Jan Philipp Albrecht presented a project designed to strengthen the protection of personal data on the Internet. Following the recommendations of the European Commission on the subject, he unveiled a text strengthening the right to oblivion (. Pdf), requiring notification of data loss for business or creating a right to portability of personal information.
In a footnote, the CNIL pointed out that three basic points should be especially prohibited:

The criterion of competence of the supervisory authorities. A citizen or company should refer to the authority of the personal data protection of his country and not the country in which the publisher is. "This criterion also ensures better protection of human rights and reduced business risk and legal uncertainty, forum shopping," says the CNIL.

The single point of contact. A company whose business spans several States shall refer to a single entity. This "leader" will then lead the discussion and deal with issues with her sisters.

The role of the European data protection. It will have decision-making power on the draft decisions of a supervisory authority.

Regarding the protection of citizens' rights to speak, the CNIL invites Europe to continue his work on the use of "pseudonyms and anonymity of data, the free exercise of the right of opposition, which should be offered in clear and simple terms by the controllers. " In addition, it will weigh all his weight so that the Community regulation put in place a genuine right to dereference all.
